@mab the theocracy was disrupted by Roman conquest. Herod was a puppet appointed by Rome. You also have to remember that Herod wasn't in 'outside society'. He was a bedouin Jew. So it was actually a member of 'the church' correcting his brother in the faith, which isn't wrong.
