I got. . Bought a phone from carphone warehouse few month ago and it crashed out and needed flashing, anyway after waiting 5 weeks to get my phone back (only had it 2 days) and its gone again, am i within my rights to demand a new phone cos am not waitin 5 weeks again for it to go again * +

In theory if i had it repaired it again and it took 5 weeks to repair then thats ten weeks my phone has been out of action so the guarantee should be 14 month if ya get what am sayin * +

consumer rights though. you have bought a product which is deemed to be faulty. if you can't get a replacement then demand your money back. although you have a contract which says you aren't entitled to a new phone. the contract also states that they are responsible for maintaining a quality of service or something similar. which clearly isn't being provided. granted carphone warehouse is * +

a third party agent outwith the main networks / phone manufacturers but it doesn't mean that you should accept a third rate service from them. if all else fails do some research yourself to the nearest sony centre that can fix the fault it will mean sending off your phone again but if it gets it sorted then its to your advantage. * +

and if all else fails, go into the shop on a busy day and say very loudly I WISH TO MAKE A COMPLAINT I HAVE BEEN SOLD A FAULTY PHONE AND YOU ARE UNWILLING TO REPLACE IT DESPITE HAVING A CONTRACT WITH YOU. AS A COMPAINY THIS IS NOT THE KIND OF SERVICE I EXPECT.............no doubt they will lose some business over it. try it once a week till they replace it * +
