Thought provoking prophesy of Rasoolullah(saw): People will appoint ignorant persons as their religious leaders, who will give Fatwa (legal verdict) without knowledge n will mislead their ownselves as well as others, beware of those misleaders! * +

Accoding 2 Shariah this is a married - nikahed woman which is haram - non-permissive n cant be married by the father-in-law unless 1st duly talaq - divorced n after duration of her Iddat...

Quran states marry not the women whom yr father copulated.Fatwa thus dissolves this r*ped women's marriage, restraining the husband n wife living 2gether.Even though she was the victim of her father-in-laws lust.Fatwa rules has the strength of religion with impact of believers abiding by it.For example even this r*ped victim is ready 2 accept the Fatwa that dissolves her marriage... * +

if it states, marry not, does that not infer, before the actual marriage ceremony, as opposed to during, in which case terms like seperate, and or divorce are preferred and does copulate...not carry the inherent meanin of mutual consensual acts, * +

As I said in my previous posts on my 'someofme' tag, it was r*pe. Not sexual intercourse of any sorts. That would imply consensual. It was r*pe. The ''haraam'' aspect you're talkin about I would assume falls under adultry or zinna etc. The victim of r*pe has done nothing wrong and I agree 100 percent with Imam Shafi's ruling that she has suffered enough. They have done the right thing not followin the ruling that their marriage has been disolved imo.

Yes, you maybe correct @rape while the other side cannot be ignored i.e all types of intercourse. However, at the end it is Hanafi stand. Wallah 3alam. Hi .. Can you make it simple from Salafi link how ''Al-Shafii debated some Iraqi jurists on this matter.*'' http://en.islamtoday.net/artshow-416-2990.htm * +
