a life insurer here has come under fire for refusing to pay out a policy for a man murdered in a hijacking....

he apparently had high blood sugar which he didn't reveal to the insurer .... he has been for a few tests during the past few years and didn't disclose this...

the life insurer have no refused to pay out for this reason. they have said that they would repay all the installments the man had paid tho. * +

I have been quite surprised at the lack of knowledge and logic displayed by the public regarding this....

imo, the insurer have the right to refuse this and are mornin the wrong... even tho the man didn't die from a sugar related illness, he was not being honest... it's about the precedence and not the reason of death * +

I read last night Momentum have agreed to pay out the policy in full and have said they will pay other policies where there was similar non disclosure up to R3m.

It's a difficult one. On the one hand, by the letter of the agreement, the insurer was right. But on the other hand, does the law protect such contracts that may have unreasonable or arbitrary clauses in them.

Personally I think the government should re look at both short and long term insurance law and try to bring them more in line with current consumer protection laws. The underlying principle of insurance law is that the claimant should not be enriched by a claim. Similarly, I think this should also apply to insurers in their attempts, sometimes unscrupulous, to repudiate claims.

The bottom line in this specific case is that Momentum greatly underestimated public sentiment and now are trying to play catch up. It's not their claims dept. that messed up, it's their PR dept. and Executive leadership. * +

What has his high sugar level got to do with being murdered. Could he have avoided being murdered if his sugar levels were normal? * +

they'd have cancelled his policy upon hearing. his previous payments would've been wasted for sure.

actually maybe they'd offer him a new much higher premium. * +
