If that was the case then phones like Nokia N77, N92, N96, Samsung P900 etc... would have been illegal, I don't believe a TV License was that big of a deal as the phones used separate tech, if I am not mistaken. There are still Mobile TV gadgets out there, e.g. we have the DSTV WALKA here in SA and TV License is not required for it.
My personal assumption is that the content creators were stumped with no backing and the big TV studios didn't see mobile being profitable, especially back between 2005 and 2009, where smartphones were a small portion of the market and back then phones were seen as just phones by the masses and not content consumption tools. Mobile TV will eventually make a comeback, just watch, the moment Netflix, Hulu etc...begin focusing on Mobile, the traditional TV broadcasters will follow suit and mobile manufacturers will do to, especially with 4G LTE gaining mass adoption and 5G in the works. * +

TV company's probably didn't think mass people would watch TV on their phones like the do know, everyone has stopped paying for their license cause the say they watch TV on line, you can watch sky on ya phone though * +
